This Privacy Policy describes how ShopAdvisor Inc., doing business as Wingman and operating at getwingman.io and related services, collects, uses, shares, and protects personal information.

Wingman provides software that enables conversations and support interactions between an end user and a representative through an enterprise customer's website, application, or service. These interactions may take place through text chat, voice, video, screen sharing, callbacks, tickets, and related communication tools. Depending on the engagement, the representative may be provided by the enterprise customer or by Wingman. Wingman may also provide related features such as recording, transcription, summarization, feedback collection, and follow-up tools.

By accessing, using, or interacting with Wingman, you acknowledge this Privacy Policy. Where required by applicable law, we will also provide additional notices, choices, or requests for permission for specific data practices, including the use of cookies and similar technologies.

This Privacy Policy applies to our website, our software, our widget, our communications, and related services that link to or reference this Privacy Policy.

1. Who We Are

"Wingman," "ShopAdvisor," "we," "us," and "our" mean ShopAdvisor Inc., a Delaware corporation.

2. How Wingman Fits Into the Relationship

Wingman is used by enterprise customers on their websites, applications, or services so that their end users can communicate with a representative through Wingman.

In many cases, we handle personal information as part of providing the Wingman service to the enterprise customer and according to that enterprise customer's instructions. In other cases, we use personal information for our own business purposes, such as operating our website, managing customer relationships, providing support, maintaining security, invoicing, improving our services, and complying with legal obligations.

If you are an end user interacting with Wingman through an enterprise customer's website, application, or service, that enterprise customer may separately control certain aspects of the relationship with you, including what information is collected, which representative is assigned, what content is recorded, and how information is used in connection with that enterprise customer's own products, services, policies, and operations. In those cases, you should also review that enterprise customer's privacy policy.

3. Information We Collect

Depending on how you interact with Wingman, we may collect the following categories of personal information:

  • Contact information, such as name, email address, phone number, mailing address, or billing address.
  • Account and business information, such as company name, job title, login details, and customer support information.
  • Conversation and support information, such as conversation history, tickets, timestamps, notes, preferences, follow-up details, and issue-resolution details.
  • Conversation content, such as text chat messages, audio, video, recordings, transcripts, summaries, images, documents, screen-sharing content, and other materials shared during a conversation or support interaction.
  • Transaction or service-related information, such as product or service interests, order-related details, account context, and support-related details shared during the interaction.
  • Technical and usage information, such as IP address, browser type, device information, operating system, approximate location based on IP, referral URLs, timestamps, and usage logs.
  • Callback and contact information, such as a phone number provided so that a representative can call the end user back.
  • Communications information, such as messages sent to us, meeting requests, survey responses, ratings, feedback, and support or sales communications.
  • Marketing information, such as preferences for receiving communications from us.
  • Any other information you, an enterprise customer, or an authorized representative chooses to provide in connection with the service.

4. How We Collect Information

We collect personal information:

  • directly from you;
  • from enterprise customers that use Wingman;
  • from representatives using the Wingman service;
  • automatically through use of our website, widget, and services;
  • from service providers and integrations that help us operate the service; and
  • from publicly available or business-related sources where permitted by law.

5. How We Use Information

We may use personal information to:

  • provide, operate, and maintain Wingman;
  • enable and manage conversations, support interactions, callbacks, tickets, and related communications;
  • facilitate interaction between end users and representatives;
  • provide support to enterprise customers, end users, and representatives;
  • create, store, review, and deliver recordings, transcripts, and summaries where enabled or required for the service;
  • personalize and improve the user experience;
  • review, troubleshoot, monitor, and improve the performance, quality, reliability, and safety of our services;
  • send service-related messages, updates, and administrative communications;
  • collect ratings, survey responses, and other feedback;
  • detect, investigate, and prevent fraud, abuse, security incidents, or other harmful activity;
  • comply with legal obligations and enforce our agreements; and
  • carry out other disclosed purposes reasonably related to operating our business.

We do not use personal information shared by end users in conversations, support interactions, tickets, recordings, transcriptions, summaries, or screen-sharing sessions for our own marketing or advertising purposes.

If an end user provides a callback number, we use that number to return the requested call, continue the relevant conversation or support interaction, and handle closely related service follow-up. We do not use callback numbers for unrelated marketing to end users.

6. Representatives and Access to Information

Wingman supports live and asynchronous interactions between an end user and a representative. That representative may be provided either by the enterprise customer or by Wingman.

If the representative is provided by the enterprise customer, the enterprise customer generally controls that representative's role, permissions, supervision, and use of information. Wingman may provide product-level access controls, but the enterprise customer is responsible for how it authorizes and manages its own personnel.

If the representative is provided by Wingman, that representative may access personal information and conversation content as reasonably necessary to provide the service, support the enterprise customer, maintain service quality, follow internal policies, and comply with legal obligations.

7. Conversations, Recording, Transcription, Summarization, and Screen Sharing

Wingman may support text chat, voice, video, recording, transcription, summarization, and screen sharing.

If an enterprise customer enables these features, we may collect, store, process, and share conversation content, recordings, transcripts, summaries, and screen-sharing content in order to provide the service, generate outputs, support quality assurance, maintain security, troubleshoot issues, improve service performance, and meet contractual or legal requirements.

Wingman may also support screen sharing. By default, any screen visibility provided through the Wingman experience is limited to the website, application, or service context in which Wingman is being used. If an end user chooses to share a broader view of their device or screen, that happens only when the end user takes an explicit action to do so.

Whether a conversation is recorded, transcribed, summarized, or shared may depend on product configuration, enterprise customer settings, applicable disclosures, and applicable law.

8. Sensitive Information Shared During Conversations

We ask end users and representatives not to share unnecessary sensitive information through Wingman.

If we see credit card information, password information, or similar highly sensitive information shared during a conversation, support interaction, ticket, recording, transcript, summary, or screen-sharing session, we do not use that information for any unauthorized activity. We use such information only as reasonably necessary to provide the service, secure the platform, comply with legal obligations, follow enterprise customer instructions, or protect users and the integrity of the service.

9. How We Share Information

We may share personal information with:

  • enterprise customers and their authorized personnel;
  • representatives using the Wingman service;
  • our affiliates and service providers that help us host, operate, support, secure, analyze, or improve the service;
  • payment processors, communications providers, infrastructure providers, analytics providers, and other vendors involved in delivering the service;
  • professional advisors such as lawyers, auditors, insurers, and accountants;
  • law enforcement, regulators, courts, or other third parties when we believe disclosure is required by law or reasonably necessary to protect rights, safety, property, or the integrity of the service; and
  • a buyer, investor, successor, or other relevant party in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar corporate transaction.

We do not sell personal information for money.

We may also disclose information as directed by an enterprise customer, by the individual involved, or as otherwise described at the time of collection.

10. Cookies and Similar Technologies

Wingman and its service providers may use cookies, pixels, local storage, and similar technologies to operate the website and services, keep conversations active, remember preferences, maintain security, understand usage, and support core product functionality.

For the Wingman widget to function properly, we may place or access a Wingman cookie or similar technology on a browser or device. This may be needed to maintain session state, identify the correct enterprise customer context, route conversations, preserve permissions and preferences, support screen-sharing or callback workflows, prevent fraud, and keep the service secure.

Where required by applicable law or product configuration, we may ask for permission before placing or accessing the Wingman cookie or similar technologies. We provide notices, choices, and permissions as required under applicable U.S., California, European, United Kingdom, and other privacy and cookie laws.

You may be able to manage certain cookie preferences through your browser settings or other tools made available on our website. Some features may not function properly if cookies or similar technologies are disabled.

11. De-Identified and Aggregated Information

We may create and use de-identified, anonymized, or aggregated information that does not reasonably identify an individual. We may use this information for analytics, benchmarking, reporting, service improvement, product development, and other lawful business purposes.

12. Data Retention

We retain personal information for as long as reasonably necessary to provide our services, fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, enforce agreements, and maintain appropriate business and security records.

Retention periods may vary depending on the nature of the information, the context in which it was collected, enterprise customer instructions, applicable law, and operational needs.

We use reasonable technical, administrative, and organizational measures designed to protect personal information from unauthorized access, loss, misuse, alteration, and disclosure. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

14. Your Choices and Rights

Depending on where you live and subject to applicable law, you may have the right to request access to, correction of, deletion of, or a copy of certain personal information, or to object to or restrict certain processing.

If we handle your information as part of providing services to an enterprise customer, you may need to direct your request to that enterprise customer first. We may assist the enterprise customer in responding where appropriate.

You may opt out of marketing emails from us by using the unsubscribe link in those emails. You may still receive transactional or service-related messages.

15. Europe and United Kingdom

For individuals located in the European Economic Area, Switzerland, or the United Kingdom, where applicable law requires it, we process personal information on one or more of the following legal bases: performance of a contract, legitimate interests, consent, and compliance with legal obligations.

Personal information may be processed, stored, or accessed in countries other than the country where it was collected, including the United States and other countries where Wingman, its affiliates, enterprise customers, or service providers operate.

Where personal information is transferred internationally, we take steps intended to provide appropriate safeguards as required by applicable law. These safeguards may include contractual commitments, transfer mechanisms approved by applicable regulators, and other legally recognized protections.

Where required by applicable law, individuals in the European Economic Area, Switzerland, and the United Kingdom may also have the right to lodge a complaint with their local data protection authority.

16. California Privacy Notice

If you are a California resident, you may have certain rights under California law, including the right to know about the categories of personal information we collect, the sources of that information, the purposes for which we use it, and the categories of third parties to whom we disclose it.
